Can I build and live in an ADU before rebuilding a home lost in the LA fires?
In many cases, yes. A January 2025 executive order allows a certificate of occupancy for an ADU to be issued before the main house on properties substantially damaged or destroyed by the Eaton or Palisades fires, and Los Angeles County allows a standalone ADU to be built first and lived in while you rebuild. The ADU still has to meet regular ADU standards and pass all required inspections.
The normal rule and the fire exceptions
Government Code section 66328 normally bars a local agency from issuing a certificate of occupancy for an ADU before it issues one for the primary dwelling. Two exceptions matter here:
- Executive Order N-9-25 (January 16, 2025). According to LA County Regional Planning, the order suspended section 66328 for residential properties substantially damaged or destroyed by the Eaton Fire or the Palisades Fire, so the ADU can receive its certificate of occupancy first. The county states the suspension remains in effect until January 16, 2028, unless terminated earlier.
- AB 462 (effective October 10, 2025). This urgency bill added a statewide exception: an agency must issue a certificate of occupancy for a detached ADU in a county covered by a Governor's state-of-emergency proclamation made on or after February 1, 2025, if the main home was substantially damaged or destroyed by that event and the ADU has its construction permits and has passed all required inspections. It does not apply to attached ADUs.
How LA County handles standalone ADUs
For unincorporated areas such as Altadena, the county's rebuilding guidance says you can build an ADU before you rebuild your home and that regular ADU standards apply. Its Zoning Ordinance Interpretation No. 2025-04 lets a household temporarily occupy a standalone ADU while waiting for the home to be rebuilt, until January 7, 2030. When you rebuild the house, the ADU can remain without further review, but it must be shown on the site plan for the main home. The county also accepts new ADUs as part of like-for-like rebuild applications.
Pacific Palisades is inside the City of Los Angeles, where LADBS and Los Angeles City Planning handle permits, and Malibu has its own permit process. Rebuild programs and deadlines change, so confirm the current rules with the agency that covers your address.
What this means for your MEP plans and permit set
Design the ADU's utilities for the finished property, not just the first building. Size the electrical service and plan meter and panel locations so the future house can connect without tearing out new work. Have any surviving sewer lateral and water service checked before you reuse them, and show the planned path to the future house on the site plan. A new detached ADU is new construction, so it needs its own Title 24 energy compliance. A coordinated MEP set now helps avoid redesign when the main house permit is filed.
